Terms of Service

These Terms of Service explain the rules and conditions that govern your use of the Forumbee platform and related services. By accessing or using the Service, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service (the Agreement) govern your access to and use of the Forumbee.com website and the Forumbee platform used to host communities for our clients (collectively, the Service). The Service is owned and operated by Forumbee LLC (Forumbee).
By accessing or using any part of the Service, you agree to be bound by this Agreement and the Forumbee Privacy Policy, which describes how personal information is collected, used, and protected. If you do not agree to these terms, you may not use the Service.
Please note that communities hosted on the Forumbee platform are operated and controlled by the respective clients who create them. Their own community guidelines or terms may apply in addition to this Agreement.
The Service is intended for individuals who are at least 18 years old.
2. Your Account and Community
If you create an account or community, you are responsible for maintaining its security and for all activity that occurs under it. You must notify Forumbee immediately of any unauthorized access or security breaches. Forumbee is not liable for any actions or omissions by you.
3. Customer Data Ownership and License
You retain all ownership rights to the content, data, and materials that you submit or upload to the Service (Customer Data), including all content created or posted within your community on the Service. Forumbee does not claim ownership of Customer Data.
By using the Service, you grant Forumbee a limited, nonexclusive, worldwide license to host, store, reproduce, display, and process Customer Data solely for the purpose of operating, maintaining, and improving the Service.
Customer Data may include personal information. All processing of personal information is governed by the Forumbee Privacy Policy.
Upon termination of your account, Forumbee will delete or anonymize Customer Data in accordance with our internal data retention schedule, except where retention is required for legal, security, or compliance purposes. You are responsible for exporting any Customer Data prior to termination if you require a copy.
4. Prohibited Businesses and Community Types
Certain businesses, activities, and community types are not permitted on the Forumbee platform. These categories are representative but not exhaustive. If you are unsure whether your use is allowed, contact us.
Prohibited uses include:
- Adult content and services: Pornography, obscene materials, sexually related services.
- Gaming: Internet gaming, video gaming, virtual worlds.
- Gambling: Gambling, sweepstakes, lotteries, sports forecasting, fantasy leagues.
- Politically oriented groups: Political parties, candidates, activists, protest groups.
- Regulated goods or services: Marijuana dispensaries, e-cigarettes, e-liquids, online pharmacies, weapons, age restricted goods.
- Advertising businesses: Communities created for the purpose of selling advertising inventory.
- Unfair or deceptive practices: Get rich quick schemes, misleading investment offers, predatory services.
- Illegal activities: Any activity that violates laws.
- Intellectual property infringement: Unauthorized distribution of copyrighted or proprietary materials.
- Hotlinking: Directly embedding images or files hosted by Forumbee on external sites.
- Other harmful content: Defamatory, harassing, abusive, racist, obscene, fraudulent, or rights violating content.
5. Responsibility of Contributors
If you operate a community or post any content (Content), you are responsible for all such material and any harm resulting from it. By making Content available, you represent and warrant that:
- The Content does not infringe third party rights.
- You have employer permission if applicable.
- You comply with all applicable licenses.
- The Content does not contain malware or harmful code.
- The Content is not spam, misleading, machine generated, or created to promote unlawful activity.
- The Content is not pornographic or threatening and does not violate privacy or publicity rights.
- Your community is not promoted through unsolicited messages.
- Your community name does not impersonate another person or business.
- Code based Content is accurately described.
Forumbee may remove any Content that violates policies or is objectionable and may suspend or terminate access to the Service at its discretion. Payments already made are nonrefundable.
6. Payment, Renewal, and Cancellation
Subscription Plans
Paid subscription plans and add-on services are available on the Service. By selecting a plan, you agree to pay the indicated monthly or annual fee. Payments are charged in advance and cover the corresponding subscription period.
Automatic Renewal
Subscriptions renew automatically at the end of each billing period (monthly or annual), and the customer authorizes Forumbee to charge the applicable fee using any valid payment method on file.
If a subscription is designated as non-renewing in an order form, quote, or invoice, it will not renew automatically and will expire at the end of the stated term.
Cancellation
You may cancel your subscription at any time through your Account page. Cancellation takes effect immediately. Your subscription will not renew and no further charges will be made.
Refunds
Forumbee does not provide prorated refunds for unused subscription time. In limited cases, and at Forumbee’s sole discretion, we may offer alternative resolutions such as account credits. To inquire about such options, please contact support.
7. Responsibility of Service Users
Forumbee does not review all content posted on the Service and is not responsible for its quality or effects. You use the Service at your own risk and should take precautions to protect against harmful content. The Service may contain errors or objectionable material. Forumbee disclaims responsibility for harm resulting from your use of or downloads from the Service.
8. Content on External Websites
Forumbee has no control over non-Forumbee sites linked from or to the Service. Forumbee does not endorse such sites and is not responsible for their content. Use external sites at your own risk.
9. Intellectual Property
This Agreement does not transfer any Forumbee or third party intellectual property rights to you. All trademarks and branding on the Service remain the property of their owners. You receive no license to use Forumbee trademarks unless granted in writing.
Forumbee may display attribution links such as “powered by Forumbee” in your community footer. Attribution may be removed or modified at Forumbee’s discretion.
10. Changes to Terms
Forumbee may update this Agreement at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. New features or services are also subject to this Agreement.
11. Termination
Forumbee may suspend or terminate your access to the Service if we believe it is necessary to protect the Service, our users, or to comply with legal obligations. We will make reasonable efforts to notify you when appropriate. Sections relating to ownership, warranties, liability, and indemnity will continue to apply after termination.
12. Disclaimer of Warranties
The Service is provided on an “as is” basis. Forumbee disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. Forumbee does not guarantee uninterrupted or error free service.
13. Limitation of Liability
Forumbee and its suppliers are not liable for indirect, incidental, special, or consequential damages; the cost of substitute services; interruption or data loss; or amounts exceeding the fees paid by you in the twelve months preceding a claim. Some jurisdictions do not allow certain limitations, so these may not apply.
14. General Representation
You represent that your use of the Service complies with this Agreement, the Privacy Policy, and all applicable laws. You warrant that your use does not infringe the rights of others.
15. Indemnification
You agree to indemnify and hold harmless Forumbee and its contractors, licensors, employees, and agents from all claims and expenses arising from your use of the Service or violation of this Agreement.
16. Trademarks
Trademarks displayed on the Service belong to Forumbee LLC or third parties. No rights are granted without written permission.
17. Miscellaneous
This Agreement constitutes the entire agreement between you and Forumbee. It may be modified only by a written amendment signed by Forumbee or by updated terms posted on the Service.
The Agreement is governed by the laws of Washington State. Disputes will be resolved through binding arbitration under JAMS rules in Washington, with English as the language of arbitration. The prevailing party is entitled to costs and attorney fees.
If any portion of this Agreement is found invalid, it will be interpreted to reflect the original intent, and the remainder will remain in effect. You may assign this Agreement only to parties agreeing to its terms. Forumbee may assign its rights without condition.
